LAWS OF MARYLAND

Ch. 11

(G) REPORTS.

THE HEAD OF A DEPARTMENT OR INDEPENDENT UNIT SHALL SEND TO
THE SECRETARY OF BUDGET AND FISCAL PLANNING AND THE LEGISLATIVE
AUDITOR:

(1)  A COPY OF A REPORT OF EACH EXAMINATION UNDER THIS
SECTION; AND

(2)  A WRITTEN STATEMENT THAT CONTAINS THE BASIS FOR
ANY FINDING MADE UNDER SUBSECTION (F)(1)(II) OF THIS SECTION.

(H) FEDERAL LAW.

A PROVISION OF THIS SECTION HAS EFFECT ONLY TO THE EXTENT
THAT THE PROVISION DOES NOT CONFLICT WITH FEDERAL LAW.

REVISOR'S NOTE: Subsection (a)(1) of this section is new
language used as the standard introductory language to
a definition subsection.

Subsection (a)(2) of this section is new language
added to avoid repetition of the former reference to
"any department of the State government" headed by a
secretary.

Subsection (a)(3) of this section is new language
added to allow concise reference to these units.

Subsections (b) through (h) of this section are new
language derived without substantive change from
former Art. 15A, § 28(a) through (f) and the first
sentence of (g).

In subsections (b)(1) and (2), (c), (e), and
(f)(l)(ii) of this section, the word "provider" is
substituted for the former word "vendor", for clarity.

In subsection (c)(1) of this section, the word
"individual" is substituted for the former reference
to "children, juveniles, or adults", for brevity.

In subsection (f)(2) of this section, the word "pay"
is substituted for the former reference to
"settlement", which could be read to encompass an
adjustment. This reading seemed unintended in light
of the specific provision for adjustment in subsection
(f)(1)(ii) of this section.

Subsection (g)(2) of this section is revised to
clarify the recipients of the required statement.

In subsection (h) of this section, the former words
"rules or regulations" are deleted as unnecessary in
light of the broad word "law".
