former Art. 19, § 8, to countersigning checks, and the
reference, in the first sentence of former Art. 95, §
7, to signing checks.

This section is revised to state a requirement, rather
than to enable a deputy to exercise powers. Thus, in
item (1) of this section, the specific reference to
the "Treasurer" is added. Similarly, in item (2) of
this section, the specific reference to the
"Comptroller" is added. This revision reflects Md.
Constitution, Art. VI, § 3, which requires the
Treasurer or an authorized deputy to disburse money on
warrant "and on checks countersigned by the
Comptroller, or his duly authorized deputy."

Also in light of Md. Constitution, Art. VI, § 3, the
reference, in former Art. 95, § 7, to the power of a
deputy treasurer to "countersign" a check is deleted.

In the introductory language of this section, the
reference to a check to disburse "money from the State
Treasury" is substituted for the former reference to a
check drawn "upon any bank or banks in which the
monies of the State may from time to time be
deposited", since entities other than "bank[s)" may
serve as depositaries and there seemed to be no intent
to exclude these entities.

Title 2, Subtitle 3 of this article.

7-228. RECEIPTS.

THE TREASURER, THE CHIEF DEPUTY TREASURER, OR A DEPUTY
TREASURER SHALL KEEP A RECEIPT FOR MONEY DISBURSED FROM THE STATE
TREASURY.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause of
the second sentence of former Art. 95, § 7.

The specific reference to the "Treasurer" is added for
clarity.

7-229. UNDELIVERABLE CHECKS FUND.

(A)  "FUND" DEFINED.

IN THIS SECTION, "FUND" MEANS THE UNDELIVERABLE CHECKS FUND.

(B)  ESTABLISHED.

THERE IS AN UNDELIVERABLE CHECKS FUND.

(C) DUTIES OF COMPTROLLER.
