A BUDGET AMENDMENT MAY NOT CHANGE ANY LANGUAGE OR
SUBSTANTIVE PROVISION IN THE STATE BUDGET.
(B) FIGURES.
THE LIMITATION IN THIS SECTION DOES NOT APPLY TO THE
MONETARY FIGURES OF AN APPROPRIATION.
REVISOR'S NOTE: This section is new language derived
without substantive change from the first sentence of
former Art. 15A, § 8(g).
This section is set forth as a separate section to
clarify its applicability to an amendment for the
Legislative Branch or the Executive Branch.
Although former Art. 15A, § 8(f) also seemed to be a
general restriction on all amendments, the former
subsection was, by specific cross-reference,
applicable to amendments for the Executive Branch.
Therefore, the absence of a cross-reference in the
provisions that related to the Legislative Branch
suggested that former § 8(f) was inapplicable to that
Branch, and the Secretary of Budget and Fiscal
Planning indicates that former § 8(f) has never been
construed to apply to the Legislative Branch.
However, there were no similar indications of a
limitation on the applicability of the first sentence
of former § 8(g).
Former Art. 15A, § 8(h) also provided that,
"[notwithstanding ... subsection (g)", the boards of
certain universities and colleges may transfer money
"without submitting an amended schedule". See § 7-212
of this subtitle. This section, as revised, would
apply if a board elects to submit a proposed amended
schedule.
7-211. AMENDMENTS FOR DEPARTMENT OF TRANSPORTATION.
(A) REPORT OF SECRETARY.
ON OR BEFORE THE 3RD WEDNESDAY IN JANUARY OF EACH YEAR, THE
SECRETARY OF TRANSPORTATION SHALL SUBMIT TO THE GENERAL ASSEMBLY,
SUBJECT TO § 2-1312 OF THE STATE GOVERNMENT ARTICLE, A REPORT ON
AMENDMENTS OF APPROPRIATION SCHEDULES OF THE DEPARTMENT OF
TRANSPORTATION.
(B) CONTENTS OF REPORT.
(1) A REPORT UNDER THIS SECTION SHALL DESCRIBE EACH
PROPOSED AMENDED SCHEDULE THAT THE DEPARTMENT HAS SUBMITTED OR
EXPECTS TO SUBMIT DURING THE CURRENT FISCAL YEAR UNDER § 7-209 OF
THIS SUBTITLE.
