Subsection (d)(2)(i) and (ii) of this section is new
language substituted for the fifth clause of former
Art. 15A, § 8(f) and the provisions of the second
sentence of § 20(d) that related to the Executive
Branch.
Subsection (d)(2)(iii) of this section is new language
substituted for the third sentence of former Art. 15A,
§ 20(d), which stated that "all actions in which the
ceiling is exceeded [are] temporary until approved by
the General Assembly at its next session."
Subsection (e) of this section is new language derived
without substantive change from former Art. 15A, §
8(i) and the second sentence of (g).
Subsection (f) of this section is new language derived
without substantive change from the reference, in the
second clause of former Art. 15A, § 8(d), to
"transmission to the Comptroller" and the fifth
sentence and the first clause and, except for the
reference" to a "certificate of approval", the second
clause of the second sentence of (e).
Subsection (g) of this section is new language
substituted for the third clause of the second
sentence of former Art. 15A, § 8(e) and, except for
the reference to "transmission to the Comptroller",
the second clause of (d).
In subsection (a) of this section, the former language
"if it is necessary" is deleted as unnecessary in
light of the word "may".
In subsection (b)(1) through (3) of this section, the
references to a "proposed amended schedule" are
substituted for the former references to an "amended
schedule" and "amended budget schedule", for clarity.
The introductory language of subsection (b)(1) of this
section, "[e]xcept as provided in § 7-212 of this
subtitle," is added as a general reference to the
authority of the Boards of Regents of Morgan State
University and the University of Maryland and the
Boards of Trustees of St. Mary's College and the State
Universities and Colleges under former Art. 15A, §
8(h). This addition exempts the Boards from the
general requirement, in former Art. 15A, § 27, for
submission of a proposed amended schedule to the
Secretary of Budget and Fiscal Planning. Although
former § 8(h) did not expressly exempt the Boards from
§ 27, the Boards were expressly exempted from the
requirement to submit a proposed amended schedule to
the Governor and, therefore, the requirement to submit
the schedule to the Secretary "before the same is
