scholarship programs generally and Art. 38A, § 42B of
the Code, for the scholarship and other programs of
the Maryland Firemen's Association.

Other provisions that may mandate appropriations as
needed include: (1) Art. 41, § 188A(f) of the Code,
for the Sundry Claims Board; and (2) Art. 64A, §
56(c) of the Code, for satisfaction of awards or
judgments under the Merit System Law.

Subsection (b) of this section is new language added
to reflect the requirement of the seventh sentence of
present Art. 64A, § 27(a) of the Code, with respect to
those salaries to which the salary plan applies.
However, see 62 Op. Att'y Gen. 674 (1977).

In subsection (a)(3) of this section, the reference to
the "Legislative Branch" is used instead of the
references, in the Md. Constitution, to the "General
Assembly" and the "Legislative Department", to
standardize references to the Branches of the State
government and to clarify the scope of these
appropriations.

Similarly, in subsection (a)(4) of this section, the
reference to the "Judicial Branch" is used instead of
the archaic references, in the Md. Constitution, to
the "Judiciary Department" and "Judiciary".

7-109. STATEMENT OF NONCLASSIFIED POSITIONS.

SO THAT THE GENERAL ASSEMBLY MAY KNOW THE EXTENT AND COST OF
THE NONCLASSIFIED POSITIONS THAT THE GENERAL ASSEMBLY HAS CREATED
AND WANTS TO MAINTAIN OUTSIDE THE CLASSIFIED SERVICE, EACH BUDGET
BILL SHALL CONTAIN A SEPARATE SECTION THAT, BY UNIT OF THE STATE
GOVERNMENT, STATES:

(1)  THE JOB CLASSIFICATION OF EACH NONCLASSIFIED
POSITION IN THE UNIT WITH FLAT RATE OR PER DIEM COMPENSATION;

(2)  THE NUMBER OF POSITIONS IN EACH OF THOSE JOB
CLASSIFICATIONS; AND

(3)  THE APPROPRIATION REQUESTED FOR EACH OF THOSE JOB
CLASSIFICATIONS.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 15A, §
20(c).
