THE DEPARTMENT SHALL PRESENT THE PLAN TO THE GOVERNOR, TO
THE MEMBERS OF THE GENERAL ASSEMBLY, AND TO ANNE ARUNDEL,
CALVERT, CHARLES, HOWARD, MONTGOMERY, PRINCE GEORGE'S, AND ST.
MARY'S COUNTIES.
REVISOR'S NOTE: Subsection (a) of this section formerly
appeared as Art. 88C, § 2(c)(9)(ii).
Subsection (b) of this section is new language derived
without substantive change from former Art. 88C, §
2(c)(9)(iii).
In subsection (b) of this section, the names of the 7
enumerated counties are substituted for the former
words "the appropriate local jurisdictions", for
clarity. This revision is called to the attention of
the General Assembly.
The only other changes are in style.
The Commission to Revise the Annotated Code points out
to the General Assembly that it is unclear whether
this section should be decodified as obsolete. If the
presentation requirements of this section apply only
to the Plan itself, then the General Assembly may wish
to decodify this section as obsolete in light of the
Department having fulfilled the presentation
requirements. However, if the presentation
requirements apply not only to the Plan, but also to
updates and revisions of the Plan under § 5-913 of
this subtitle, then this section should be retained
and possibly clarified.

5-912. APPROVAL BY GENERAL ASSEMBLY.
(A) PRESENTATION TO GENERAL ASSEMBLY FOR APPROVAL.
ON APPROVAL BY RESOLUTION OF AT LEAST 5 OF THE 7 COUNTIES
LISTED IN § 5-911(B) OF THIS SUBTITLE, THE DEPARTMENT SHALL
PRESENT THE PLAN, ALONG WITH ANY APPROPRIATE COMMENTS FROM THE
COUNTIES, TO THE GENERAL ASSEMBLY FOR APPROVAL AS THE PATUXENT
RIVER WATERSHED MASTER PLAN.
(B) EFFECT OF APPROVAL.
THE PLAN, ONCE APPROVED, SHALL SERVE AS A POLICY GUIDE TO BE
USED BY UNITS OF THE STATE GOVERNMENT AND LOCAL GOVERNMENTS IN
CARRYING OUT THEIR ACTION AND REGULATORY PROGRAMS IN THE PATUXENT
RIVER WATERSHED.
