5-705. BASIS OF PLAN PROGRAM.

AS FAR AS POSSIBLE, THE CAPITAL PROGRAM SHALL BE BASED ON
EXISTING INFORMATION IN THE POSSESSION OF THE DEPARTMENT OF STATE
PLANNING, THE DEPARTMENT OF BUDGET AND FISCAL PLANNING, AND OTHER
UNITS OF THE STATE GOVERNMENT.

REVISOR'S NOTE: This section formerly appeared as the sixth
sentence of Art. 88C, § 6.

The words "other units of the State government" are
substituted for the former phrase "other departments
and agencies of State government", for consistency
with similar provisions elsewhere in this article.

The only other changes are in style.

5-706. REQUESTS FOR CAPITAL PROJECTS.

(A)  SUBMISSION TO DEPARTMENT.

THE HEAD OF EACH UNIT OF THE STATE GOVERNMENT SHALL SEND ANY
REQUEST FOR A CAPITAL PROJECT PROPOSED BY THE UNIT TO THE
SECRETARY FOR STUDY, ADVICE, AND RECOMMENDATION BY THE DEPARTMENT
OF STATE PLANNING AND FOR CONSIDERATION FOR INCLUSION IN THE
CAPITAL PROGRAM.

(B)  ADDITIONAL INFORMATION.

THE DEPARTMENT OF STATE PLANNING OR THE DEPARTMENT OF BUDGET
AND FISCAL PLANNING MAY REQUIRE THE HEAD OF ANY UNIT OF THE STATE
GOVERNMENT TO GIVE INFORMATION NECESSARY FOR THE PREPARATION OF
THE CAPITAL PROGRAM.

REVISOR'S NOTE: This section is new language derived
without substantive change from the seventh and eighth
sentences of former Art. 88C, § 6.

In subsections (a) and (b) of this section, the phrase
"each unit of the State government" is substituted for
the former phrases such as "departments and other
agencies and instrumentalities of State government"
for consistency with similar provisions elsewhere in
this article.

5-707. REVOLVING PRELIMINARY PLANNING FUND.

(A) FUND ESTABLISHED.

IN THE ANNUAL BUDGET THE GOVERNOR SHALL PROVIDE A SUM
SUFFICIENT TO ESTABLISH A REVOLVING PRELIMINARY PLANNING FUND
UNDER THE JURISDICTION OF THE BOARD OF PUBLIC WORKS.
