BUILDING.

Defined term: "Building" § 4-801

(E) LIFE-CYCLE COSTS.

"LIFE-CYCLE COSTS" MEANS THE SUM OF THE FOLLOWING COSTS OF A
BUILDING:

(1)  THE COST OF INITIAL CONSTRUCTION;

(2)  THE COST OF ALL ENERGY CONSERVATION MEASURES;

(3)  THE COST OF OPERATION AND MAINTENANCE, INCLUDING
LABOR AND MATERIALS, FOR THE LIFE OF THE BUILDING;

(4)  THE COST, OVER THE LIFE OF THE BUILDING, OF THE
FUEL USED BY:

(I)  THE EQUIPMENT THAT CONTROLS OR PROVIDES THE
HUMIDITY, LIGHTING, POWER, TEMPERATURE, AND VENTILATION OF THE
BUILDING; AND

(II)  OTHER ENERGY-USING EQUIPMENT IN THE
BUILDING; AND

(5)  THE OTHER COSTS INCIDENT TO OWNING THE BUILDING.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Art. 78A, §§
25B(e) and 25E(b).

In item (2) of this subsection, the words "to reduce a
building's energy or fuel consumption"; which formerly
followed the words "energy conservation measures", are
deleted as redundant.

In item (3) of this subsection, the words "reasonable"
and "probable", which formerly modified the reference
to maintenance costs, are deleted. Similarly, in item
(4) of this subsection, the words "reasonably
expected", which formerly modified the reference to
fuel costs, and the words "as determined by the
Department", which formerly followed the Words "over
the life of the building", are deleted. The
Commission to Revise the Annotated Code believes that
the deleted words are unnecessary and inappropriate to
the definition in this subsection, since those words
go to the application of the definition rather than to
the definition itself. This revision is called to the
attention of the General Assembly.
