4-406. POWERS AND DUTIES OF DEPARTMENT RELATING TO PUBLIC
IMPROVEMENTS.

(A) ENGINEERING QUESTIONS AND MATTERS.

(1)  THE DEPARTMENT SHALL ADVISE THE BOARD OF PUBLIC
WORKS AND ANY UNIT OF THE STATE GOVERNMENT, INCLUDING THE
UNIVERSITY OF MARYLAND, IN CONNECTION WITH ANY ENGINEERING
QUESTION OR MATTER CONCERNING A PUBLIC IMPROVEMENT.

(2)  THE DEPARTMENT SHALL SUPERVISE ANY ENGINEERING
QUESTION OR MATTER CONCERNING A PUBLIC IMPROVEMENT.

(3)  ANY CONTRACT, PLAN, OR SPECIFICATION FOR ANY
PUBLIC IMPROVEMENT THAT INVOLVES AN ENGINEERING QUESTION:

(I)  SHALL BE SUBMITTED TO THE DEPARTMENT; AND

(II)  IS SUBJECT TO THE APPROVAL OF THE
DEPARTMENT.

In paragraph (1) of this subsection, the phrase
"including the University of Maryland" is added, for
clarity, in light of §§ ll-101(i) and (s), ll-202(a),
and 19-201(f) of this article.

Also in paragraph (1) of this subsection, the phrase
"any unit of the State government" is substituted for
the former phrase "other State departments or
agencies", to conform to similar provisions elsewhere
in this title.

Also in paragraph (1) of this subsection, the former
phrase "except those exempted in § 20 of this article"
is deleted as unnecessary in light of the enumeration
of excepted units in § 4-402 of this subtitle.
