(C)  DIVISION.

"DIVISION" MEANS THE LAND ACQUISITION DIVISION OF THE
DEPARTMENT.

avoid repetition of the full title "Land Acquisition
Division".

Defined term: "Department" § 4-101

(D)  PUBLIC IMPROVEMENT.

"PUBLIC IMPROVEMENT" INCLUDES ANY CONSTRUCTION, MAINTENANCE,
OR REPAIR OF ANY BUILDING, STRUCTURE, OR OTHER PUBLIC WORK:

(1)  OWNED OR CONSTRUCTED BY THE STATE OR ANY UNIT OF
THE STATE GOVERNMENT, INCLUDING THE UNIVERSITY OF MARYLAND; OR

(2)  ACQUIRED OR CONSTRUCTED IN WHOLE OR IN PART WITH
STATE FUNDS.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from the first clause of
the first sentence of former Art. 78A, § 20.

In item (1) of this subsection, the language "any unit
of State government" is substituted for the former
language "the State of Maryland or any department,
officer, board, commission or agency thereof", for
brevity, clarity, and to conform to similar provisions
elsewhere in this title.

4-402. SCOPE OF SUBTITLE.

(A) IN GENERAL.

THIS SUBTITLE DOES NOT APPLY TO ANY PUBLIC IMPROVEMENT MADE
BY:

(1)  THE DEPARTMENT OF TRANSPORTATION OR A UNIT IN
THAT DEPARTMENT;

(2)  ANY HOUSING AUTHORITY CREATED UNDER ARTICLE 44A
OF THE CODE;

(3)  THE MARYLAND-NATIONAL CAPITAL PARK AND PLANNING
COMMISSION;

(4)  THE WASHINGTON SUBURBAN SANITARY COMMISSION;
