CONSISTENT WITH DIVISION II OF THIS ARTICLE, THE SECRETARY
SHALL CONTRACT FOR OR PURCHASE ANY SUPPLIES FOR A USING AGENCY
EXCEPT AN ITEM THAT THE SECRETARY:

(1) DETERMINES IS STRICTLY PERISHABLE;

(2) DETERMINES IS IMPRACTICABLE FOR A USING AGENCY TO
PURCHASE THROUGH OR WITH THE APPROVAL OF THE SECRETARY; OR

(3) PERMITS THE USING AGENCY TO PURCHASE WITH THE
APPROVAL OF THE SECRETARY.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 41, §
231G(c).

In item (3) of this section, the former words "under
the authority", are deleted as included in "with the
approval".

4-314. ESTIMATES OF AMOUNT OR QUALITY.

AT TIME INTERVALS SET BY THE SECRETARY, EACH USING AGENCY
SHALL SEND TO THE SECRETARY ESTIMATES OF THE AMOUNT AND QUALITY
OF ANY NEEDED SUPPLIES.

4-315. PAYMENT OF CERTAIN UNAPPROVED INVOICES PROHIBITED.

(A)  IN GENERAL.

AN EMPLOYEE OF A USING AGENCY WHOSE SALARY AND EXPENSES ARE
PAID FROM THE FEES OF THE EMPLOYEE'S OFFICE MAY NOT PAY ANY
CONTRACTOR OR SELLER FOR ANY ARTICLE OF ANY KIND ACQUIRED FOR THE
USING AGENCY UNLESS THE INVOICE APPROVED BY THE EMPLOYEE IS ALSO
APPROVED BY THE SECRETARY OR A DESIGNEE OF THE SECRETARY.

(B)  PENALTY FOR VIOLATION.

THE GOVERNOR MAY REMOVE AN EMPLOYEE FOR ANY VIOLATION OF THE
PROVISIONS OF THIS SECTION.
