SUBTITLE 4. INFORMATION PROCESSING.
3-401. SCOPE OF SUBTITLE.
(A) UNIVERSITY COLLEGE OVERSEAS PROGRAMS EXCLUDED.
THIS SUBTITLE DOES NOT APPLY TO CHANGES RELATING TO OR THE
PURCHASE, LEASE, OR RENTAL OF MECHANICAL OR ELECTRONIC
INFORMATION PROCESSING EQUIPMENT OR ASSOCIATED SERVICES BY THE
UNIVERSITY COLLEGE OF THE UNIVERSITY OF MARYLAND FOR USE IN
UNIVERSITY COLLEGE OVERSEAS PROGRAMS.
(B) ACADEMIC OR RESEARCH USE EXCLUDED.
(1) THIS SUBTITLE DOES NOT APPLY TO MECHANICAL OR
ELECTRONIC INFORMATION PROCESSING EQUIPMENT OR ASSOCIATED
SERVICES TO BE USED SOLELY FOR ACADEMIC OR RESEARCH PURPOSES BY
PUBLIC INSTITUTIONS OF HIGHER EDUCATION OR THEIR GOVERNING
BOARDS. THIS SUBTITLE DOES APPLY TO MECHANICAL OR ELECTRONIC
INFORMATION PROCESSING EQUIPMENT OR ASSOCIATED SERVICES TO BE
USED IN WHOLE OR PART FOR ADMINISTRATIVE USE BY PUBLIC
INSTITUTIONS OF HIGHER EDUCATION OR THEIR GOVERNING BOARDS.
(2) PUBLIC INSTITUTIONS OF HIGHER EDUCATION AND THEIR
GOVERNING BOARDS MAY PURCHASE, LEASE, OR RENT MECHANICAL OR
ELECTRONIC INFORMATION PROCESSING EQUIPMENT OR ASSOCIATED
SERVICES TO BE USED SOLELY FOR ACADEMIC OR RESEARCH PURPOSES
WITHOUT THE APPROVAL OF THE SECRETARY.

Subsection (b) of this section is new language derived
without substantive change from former Art. 15A, §
23B(c).
Throughout this section, the words "equipment or
associated services" are substituted for the former
words "equipment and associated services", in
conformity to apparent legislative intent and
practice.
In subsection (a) of this section, the words "data
or", which formerly preceded "information", are
deleted for consistency with the language used
elsewhere in this subtitle.
