(C) OATH.

BEFORE TAKING OFFICE, THE APPOINTEE SHALL TAKE THE OATH
REQUIRED BY ARTICLE I, § 9 OF THE MARYLAND CONSTITUTION.

(D) RESPONSIBILITY
DEPARTMENT.

TO

GOVERNOR; ADMINISTRATION OF

(1)  THE SECRETARY SERVES AT THE PLEASURE OF THE
GOVERNOR AND IS RESPONSIBLE DIRECTLY TO THE GOVERNOR. THE
SECRETARY SHALL ADVISE THE GOVERNOR ON ALL MATTERS ASSIGNED TO
THE DEPARTMENT AND IS RESPONSIBLE FOR CARRYING OUT THE GOVERNOR'S
POLICIES ON THOSE MATTERS.

(2)  THE SECRETARY IS RESPONSIBLE FOR THE OPERATION OF
THE DEPARTMENT AND SHALL ESTABLISH GUIDELINES AND PROCEDURES TO
PROMOTE THE ORDERLY AND EFFICIENT ADMINISTRATION OF THE
DEPARTMENT. THE SECRETARY MAY ESTABLISH, REORGANIZE, OR ABOLISH
AREAS OF RESPONSIBILITY IN THE DEPARTMENT AS NECESSARY TO FULFILL
THE DUTIES ASSIGNED TO THE SECRETARY.

(3)  THE SECRETARY IS RESPONSIBLE FOR ESTABLISHING
POLICY TO BE FOLLOWED BY THE UNITS IN THE DEPARTMENT.

SALARY.

THE SECRETARY
STATE BUDGET.

IS ENTITLED TO THE SALARY PROVIDED IN THE

REVISOR'S NOTE: Subsections (a), (b), (d)(1) and (2), and
(e) of this section are new language derived without
substantive change from the second sentence of former
Art. 41, § 71(a), from the first, second, and third
sentences and -- as it related to the salary of the
Secretary -- the fourth sentence of (b), and from the
first and second sentences of (c).

Subsection (c) of this section is standard language
added to state the duty of an individual appointed to
any office of profit or trust to take the oath
specified in Md. Constitution, Art. I, § 9. This
addition is supported by 64 Op. Att'y Gen. 246 (1979).

Subsection (d)(3) of this section is new language that
repeats the provisions of the fourth sentence of
present Art. 41, § 3A(a). Although present Art. 41,
§ 3A(a) sets forth the general powers of all the
secretaries of principal departments, the fourth
sentence of that present subsection is repeated here
as a responsibility of the Secretary of Budget and
Fiscal Planning -- since the laws that relate to other
secretaries specifically state this power. See the
General Revisor's Note to Title 8, Subtitle 2 of the
State Government Article.
