INDICATED.

"DEPARTMENT" MEANS THE DEPARTMENT OF BUDGET AND FISCAL

(C)  SECRETARY.

"SECRETARY" MEANS THE SECRETARY OF BUDGET AND FISCAL

SUBTITLE 2. ORGANIZATION AND GENERAL AUTHORITY OF DEPARTMENT.

3-201. DEPARTMENT ESTABLISHED.

THERE IS A DEPARTMENT OF BUDGET AND FISCAL PLANNING,
ESTABLISHED AS A PRINCIPAL DEPARTMENT OF THE STATE GOVERNMENT.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first sentence of
former Art. 41, § 71(a).

It is set forth as a separate section for emphasis.

3-202. SECRETARY OF BUDGET AND FISCAL PLANNING.

(A)  POSITION AND APPOINTMENT.

THE HEAD OF THE DEPARTMENT IS THE SECRETARY OF BUDGET AND
FISCAL PLANNING, WHO SHALL BE APPOINTED BY THE GOVERNOR WITH THE
ADVICE AND CONSENT OF THE SENATE.

(B)  QUALIFICATIONS.

THE SECRETARY MUST HAVE EXPERIENCE IN PUBLIC FINANCE,
BUDGETING, MANAGEMENT, AND FISCAL PLANNING.
