HARRY HUGHES, Governor                                          73

"Law" § 1-101

SUBTITLE 2. POWERS AND DUTIES.
PART I. IN GENERAL.
2-201. POWERS AND DUTIES OF THE DIRECTOR.

(A)  RESPONSIBILITY FOR DEPARTMENT.

THE DIRECTOR IS RESPONSIBLE FOR THE OPERATION OF THE
DEPARTMENT.

(B)  IN GENERAL.

(1)  THE DIRECTOR SHALL ADMINISTER AND ENFORCE:

(I)  THE PROVISIONS OF THIS ARTICLE; AND

(II)  ANY OTHER PROVISION OF LAW THAT IS
ASSIGNED TO THE DIRECTOR OR THE DEPARTMENT FOR ADMINISTRATION OR
ENFORCEMENT.

(2)  THE DIRECTOR MAY EXERCISE ANY RIGHT OR POWER THAT
IS CONFERRED ON THE DIRECTOR OR THE DEPARTMENT.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause of
former Art. 81, § 231B(a) and the second sentence of
(b).

In subsection (a) of this section, the reference to
the Director being "responsible for the operation of
the Department" is substituted for the former
reference that the Director is the "head of the ...
Department", for clarity.

In subsection (b)(l)(ii) of this section, the former
phrase "now in force or which may hereafter be
passed", which modified "laws", is deleted as
superfluous.

In subsection (b)(2) of this section, the former
reference to "duties, obligations, and functions" is
deleted as superfluous in light of the broad
provisions of this subsection.

Also in subsection (b)(2) of this section, the former
phrase "as may now or hereafter", which modified
"conferred", is deleted as superfluous.

Defined terms: "Department" § 1-101
"Director" § 1-101

2-202. MISCELLANEOUS POWERS AND DUTIES OF THE DIRECTOR.
