PART II. ADVANCE PAYMENTS AND ADVANCE BILLING.

10-205.     ADVANCE PAYMENT OF COUNTY PROPERTY TAX.

(A)  PAYMENT AUTHORIZED.

THE GOVERNING BODY OF A COUNTY MAY AUTHORIZE, BY LAW, AN
ADVANCE PAYMENT OF COUNTY PROPERTY TAX.

(B)  CALCULATION OF PAYMENT.

THE ADVANCE PAYMENT IS CALCULATED BY APPLYING THE CURRENT
COUNTY PROPERTY TAX RATE TO THE ASSESSMENT OF THE TAXPAYER'S
PROPERTY FOR THE PRIOR YEAR.

(C)  BILLING.

IF THE ADVANCE PAYMENT IS LESS THAN THE COUNTY PROPERTY TAX
AS FINALLY DETERMINED, THE COLLECTOR SHALL SEND A BILL TO THE
TAXPAYER FOR THE DIFFERENCE.

(D)  INTEREST.

THE LAW AUTHORIZING ADVANCE PAYMENT MAY ALLOW INTEREST ON
THE ADVANCE PAYMENT. THE INTEREST MAY NOT EXCEED ANY DISCOUNTS
ALLOWED BY LAW.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause of
the first sentence and the first clause of the second
sentence of former Art. 81, § 49.

Throughout this section, the defined term "county
property tax" is substituted for the former references
to "taxes" and "tax", for clarity.

In subsections (a) and (d) of this section, the
defined term "law" is substituted for the former
references to "general resolution or ordinance" and
"local law, resolution, or ordinance", for clarity.

In subsection (a) of this section, the defined term
"governing body" is substituted for the former
references to "county commissioners" and "mayor and
city council", for clarity and to reflect Baltimore
City practice.

Also in subsection (a) of this section, the former
reference to "Baltimore" is deleted as included in the
defined term "county", for clarity.
