II. PROGRAM STRUCTURE

A.  The Program shall be located in the Office of the
Governor.

B.  The Program shall be administered by a Commission
appointed by the Governor and comprised of the
following members:

1.  Five (5) from the Maryland business community;"

2.  Three (3) from Departments of State government;

3.  One (1) from Maryland Colleges and Universities.

The Governor shall designate a member of the
Commission to serve as its Chairperson.

The members shall serve without compensation
except for necessary and proper expenses.

III. COMMISSION RESPONSIBILITIES

A.  The Commission shall devise programs and procedures
of recruitment, selection, assignment, development
and educational opportunities for Executive Fellows.

B.  The Commission shall establish salary guidelines
which define the fiscal responsibilities of State
government and the participating private sector
organizations. In developing the salary guidelines:

(1)  the Commission shall differentiate between
profit and nonprofit organizations.

(2)  the Commission shall establish criteria to
ascertain private sector ability to assume

fiscal responsibility for the Executive Fellow.

(3)  the State shall not be responsible for any
benefits for the Executive Fellow beyond agreed
upon salary arrangements.

(4)  the State shall, in no case, be responsible for
a salary in excess of an Assistant Secretary of
the Department where the Executive Fellow is
assigned.

C.  The Program, including procedures and guidelines
developed in accordance with Subsection (B) above,
shall be submitted to the Governor for approval
prior to implementation. The approved Program shall
be made available to the public upon request. The
requirements of the Administrative Procedures Act
and State Documents Law do not apply to the
