Section 21(e)(3) and (d)

Annotated Code of Maryland

(1983 Replacement Volume and 1984 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 56 - Licenses

21.

(C)(3) (D) (1) IN HARFORD COUNTY, THE PROVISIONS OF THIS
SECTION APPLY TO HAWKERS, PEDDLERS, AND MOBILE VENDORS WHO USE A
VEHICLE OR ANY TEMPORARY STAND TO SELL, BARTER, OR TRADE ANY
GOODS, WARES, AND MERCHANDISE, INCLUDING BUT NOT LIMITED TO
FURNITURE, CLOTHING, TOOLS, WORKS OF ART, PRODUCE, AND SEAFOOD.

(D)(1) (2) NOTWITHSTANDING THE PROVISIONS OF THIS SECTION,
IN HARFORD COUNTY, A HAWKER, PEDDLER, OR MOBILE VENDOR MAY NOT
OBTAIN A LICENSE OR TRADE, BARTER, OR SELL ANY GOODS, WARES, OR
MERCHANDISE WITHOUT FIRST OBTAINING THE WRITTEN PERMISSION OF THE
OWNER OR LESSEE OF THE PROPERTY ON WHICH THE MOBILE VENDOR IS
CONDUCTING BUSINESS. THE WRITTEN PERMISSION SHALL CONTAIN:

(I)  THE NAME, ADDRESS, AND TELEPHONE NUMBER OF
THE PROPERTY OWNER OWNER OR LESSEE OF THE PROPERTY;

(II)  THE NAME, PERMANENT ADDRESS, AND TELEPHONE
NUMBER OF THE HAWKER, PEDDLER, OR MOBILE VENDOR;

(III)  A DESCRIPTION OF THE MERCHANDISE TO BE
TRADED, BARTERED, OR SOLD BY THE MOBILE VENDOR, HAWKER, OR
PEDDLER; AND

(IV) A STATEMENT THAT DURING THE TIME THE
MOBILE VENDOR, HAWKER, OR PEDDLER TRADES, BARTERS, OR SELLS WITH
THE PROPERTY OWNER'S PERMISSION, THE PROPERTY OWNER IS LIABLE FOR
ALL INJURIES CAUSED BY THE MOBILE VENDOR IN THE COURSE OF THE
MOBILE VENDOR'S BUSINESS;

(V) (IV) THE TIMES OF DAY AND THE NUMBER OF
DAYS PER MONTH THE VENDOR IS ALLOWED TO OPERATE ON THE PROPERTY
OF THE OWNER; AND OR LESSEE.

(VI) THE ZONING OF THE OWNER'S PROPERTY.

(2) (3) AT ALL TIMES A HAWKER, PEDDLER, OR MOBILE
VENDOR SHALL KEEP IN THE HAWKER'S, PEDDLER'S, OR MOBILE VENDOR'S
POSSESSION, A COPY OF THE ORIGINAL WRITTEN PERMISSION OF THE
PROPERTY OWNER, AND THE LICENSE REQUIRED UNDER SUBSECTION (A) OF
THIS SECTION. THE HAWKER, PEDDLER, OR MOBILE VENDOR SHALL
PRODUCE A COPY OF THE WRITTEN PERMISSION AND LICENSE UPON
REQUEST.
