subtitle [will] MAY result in SUBSTANTIAL OR irreparable harm to
any citizen of this State, may seek:
(1) [A] A permanent or temporary injunction with
respect to the conduct from the circuit court of any county in
which the alleged violation is occurring, or in which the
violator has its principal place of business, [and] OR
(2) restitution or an order requiring satisfactory
completion of the home improvement contract.
(B) The Commission is [not] NEITHER required to file a bond
NOR REQUIRED TO SHOW A LACK OF AN ADEQUATE REMEDY AT LAW when
seeking an injunction under this section [against any person,
association, copartnership, or corporation not licensed under
this subtitle].
260.
(a) The [commissioners shall suspend or revoke any license
or authority to do business] COMMISSION MAY IMPOSE A SANCTION
DESCRIBED IN SUBSECTION (C) only after A hearing. At least 10
days prior to the date set for the hearing, the [commissioners]
COMMISSION shall notify the licensee in writing of any charge
made and afford [said] THE licensee an opportunity to be heard in
person and by counsel [in reference thereto] ON ANY CHARGES.
[Such] THE written notice shall be served by delivery of the
[same] NOTICE to the licensee by registered or certified mail to
the business address of [such] THE licensee of record with the
Commission. The [commissioners] COMMISSION shall have the power
to subpoena and bring before [them] IT any person or documents,
and to take the testimony of any person under oath in the same
manner as is prescribed in judicial procedure in courts of this
State in civil cases, with the same fees and mileage as may be
provided by law for civil cases.
(c) (1) If the [commissioners shall] COMMISSION [determine]
DETERMINES that any licensee is guilty of any violation of any of
the provisions of this subtitle, the [authority of the licensee
to do business may be revoked or suspended] COMMISSION MAY:
(I) SUSPEND THE LICENSEE'S LICENSE for such
period of time as shall be determined by the [commissioners.]
COMMISSION;
(II) REVOKE THE LICENSEE'S LICENSE; OR
(III) REPRIMAND THE LICENSEE; OR.
(IV) ASSESS A CIVIL PENALTY AGAINST THE
LICENSEE NOT EXCEEDING $2,000 FOR EACH VIOLATION.
(2) THE COMMISSION MAY IMPOSE ANY COMBINATION OF THE
SANCTIONS DESCRIBED IN THIS SUBSECTION.
