AN ACT concerning

Washington County - Licenses - Zoning Requirement

FOR the purpose of permitting, before the issuance of a license
in Washington County, the filing of a certification showing
compliance with zoning ordinances from a municipal
corporation if the property is located within the municipal
corporation; making stylistic changes; and generally
relating to filing a certification showing compliance with
zoning ordinances in Washington County.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 56 - Licenses

12A.

(A)  In Washington County the clerk of the Circuit Court may
not issue a new license under this article until the applicant
files with the clerk a certification [from the county planning
commission] THAT:

(1)  STATES that the location designated in the
application is properly zoned or has a special exception for the
type of business that the applicant proposes to operate; AND

(2)  IS FROM:

(I)  THE COUNTY PLANNING COMMISSION; OR

(II)  IF THE PROPERTY IS LOCATED IN A MUNICIPAL
CORPORATION, THE MUNICIPAL CORPORATION.

(B)  This condition does not apply in the case of an
application for a renewal or reissuance of a license previously
