(2) THE BOARD OF TRUSTEES SHALL NOTIFY EACH EMPLOYEE OR
RETIREE OF THIS PROVISION BEFORE THE RELEASE OF THAT PERSON'S
NAME AND MAY NOT RELEASE THE NAME OR ADDRESS OF ANY EMPLOYEE OR
RETIREE WHO NOTIFIES THE BOARD OF TRUSTEES THAT THE EMPLOYEE OR
RETIREE DOES NOT WISH TO HAVE HIS NAME OR ADDRESS RELEASED TO AN
EMPLOYEE ORGANIZATION IN ACCORDANCE WITH THIS SECTION.

(3) THIS SECTION APPLIES ONLY TO THE FOLLOWING RETIREMENT
AND PENSION SYSTEMS:

(A) EMPLOYEES' RETIREMENT SYSTEM OF THE STATE OF
MARYLAND;

(B) TEACHERS' RETIREMENT SYSTEM OF THE STATE OF
MARYLAND;

(C) EMPLOYEES' PENSION SYSTEM; AND

(D) TEACHERS' PENSION SYSTEM.

(4) AN EMPLOYEE ORGANIZATION MAY NOT, FOR ANY PURPOSE,
RELEASE ANY OF THE INFORMATION ABOUT AN EMPLOYEE OR RETIREE THAT
IT RECEIVES UNDER THIS SECTION.

(g) (1) Subject to paragraphs (2) through [(4)] (5) of this
subsection, a custodian shall deny inspection of a retirement
record for an individual.

(5) A CUSTODIAN SHALL PERMIT RELEASE OF INFORMATION
AS PROVIDED IN ARTICLE 73 73B, § 164 OF THE CODE.

(e) [A] SUBJECT TO ARTICLE 73 73B, § 164 OF THE CODE, A
custodian shall deny inspection of the part of a public record
that contains the home address or telephone number of an employee
of a unit or instrumentality of the State or of a political
subdivision unless:

(1) the employee gives permission for the inspection;
or

(2) the unit or instrumentality that employs the
individual determines that inspection is needed to protect the
public interest.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1985 January 1, 1987.
