HARRY HUGHES, Governor

2843

(II) THE ISSUING CLERK OR PERSON DESIGNATED TO
ISSUE PERMITS SHALL RETAIN 25 CENTS AS COMPENSATION FOR EACH
PERMIT ISSUED.

(3) THE PERMIT ISSUED UNDER THIS SECTION:

(I)  ENTITLES THE HOLDER OF THE PERMIT TO HUNT
AND KILL ONLY 1 MORE ANTLERED, WHITETAIL DEER DURING THAT SAME
DESIGNATED DEER HUNTING SEASON; BUT

(II)  DOES NOT ALLOW THE HOLDER OF THE PERMIT TO
HUNT ANTLERLESS DEER.

[(d)] (E) A person may not remove the head or hide or any
part from any deer, except internal organs, or cut the meat into
parts until it has been [weighed and] checked by the Department
or one of its agents at a designated checking station. Removal
of the head or the hide of any deer, not checked at a designated
checking station shall be prima facie evidence that the deer was
hunted illegally. Each separate deer or part of any deer taken
illegally or found in possession shall be considered a separate
offense.

[(e)] (F) Any person who hunts deer and any person who
accompanies, aids, or assists another person hunting deer, shall
wear either a cap, vest, or jacket or a jacket containing back
and front panels of a daylight fluorescent orange color. This
section does not apply to any person who hunts on his property
without a hunter's license nor to any person hunting deer with a
bow and arrow during the season restricted to hunting with a bow
and arrow.

[(f)] (G) Any person who, while operating a motor vehicle
on any highway in the State, accidentally strikes and kills a
deer on the highway may have the deer if the person produces
visible evidence of collision with the deer to any natural
resources police officer, State law enforcement officer, or other
designated representative of the Secretary. The provisions of
this subsection shall be applicable to deer killed by collision
with a motor vehicle at any time whether during the open season
for killing deer or during the legally closed season.

(h) A person may not hunt a deer while it is taking refuge
in or swimming through the waters of the State.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1985.

Approved May 28, 1985.
