(C) THRESHOLD REQUIREMENTS.

THE THRESHOLDS ESTABLISHED FOR PURPOSES OF SUBSECTION
(B)(1)(II) OF THIS SECTION SHALL BE SUFFICIENTLY HIGH TO FREE THE
BOARD FROM DIRECT REVIEW OF RELATIVELY INSIGNIFICANT ITEMS WHILE
NOT IMPAIRING THE STRONG PUBLIC POLICY IN FAVOR OF DIRECT BOARD
REVIEW OF ITEMS THAT HAVE A SUBSTANTIAL FISCAL IMPACT.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 78A, §
7(c).

In subsection (b)(1) of this section, the words "unit
of the State government" are substituted for the
former words "State departments, boards, commissions,
institutions, or other agencies" and "agencies" for
consistency with language used elsewhere in this
article.

In the introductory language of subsection (b)(1) of
this section, immediately before the words "change
orders", the word "or" is substituted for the former
word "and", in conformity to apparent legislative
intent, for clarity.

21-504. CONTRACTS FOR PRISON CONSTRUCTION IN JESSUP AREA.

(A)  LIMITATION.

THE AS OF THE DATE ON WHICH THE NEW 500 BED REPLACEMENT
FACILITY AUTHORIZED JOINTLY IN CHAPTERS 519 AND 693 OF THE ACTS
OF 19,80 IS OPEN AND ACCEPTING PRISONERS, THE BOARD OF PUBLIC
WORKS MAY NOT APPROVE ANY CONTRACT FOR THE CONSTRUCTION OR
RENOVATION OF ANY PRISON FACILITIES FOR THE DEPARTMENT OF PUBLIC
SAFETY AND CORRECTIONAL SERVICES IN THE JESSUP AREA OF ANNE
ARUNDEL AND HOWARD COUNTIES THAT WOULD PROVIDE FOR MORE THAN
3,400 BEDS IN THAT AREA, COMPUTED AS FOLLOWS:

JESSUP PRE-RELEASE UNIT

(INCLUDING NEW DRUG UNIT).....................184

PATUXENT INSTITUTION..........................640

MARYLAND CORRECTIONAL INSTITUTION FOR WOMEN...249

BROCKBRIDGE CORRECTIONAL FACILITY.............515

HOUSE OF CORRECTION RENOVATION AND/OR

REPLACEMENTS (512 + 500+400+400)............1,812

TOTAL.......................................3,400.

(B)  EXCEPTION.

THE LIMITATION SET FORTH IN SUBSECTION (A) OF THIS SECTION
DOES NOT APPLY TO ANY COMMUNITY ADULT REHABILITATION CENTER.
