Office on Aging certify to the Board of Public Works that no
surplus school building or other public building appropriated
appropriate for use as an Elderly Citizen Activities Center
exists in the area where it is desired to locate a Center.

(ii) Any federal grant that is received for an
eligible project shall be applied first to the cost of the
project.

(iii) Except as provided in subsection (6)(iv),
below, a State grant may not exceed $200,000 or 50 percent of the
cost of eligible work remaining unpaid after any federal grant
has been applied, whichever is less;

(iv) At the discretion of the Board of Public Works,
a grant may exceed 50 percent of the cost of eligible work
remaining unpaid after any federal grant has been applied, up to
$200,000, if:

1.  The project involves the conversion of a
surplus public school building, or other public building or part
of a building to an Elderly Citizen Activities Center or the
rehabilitation, renovation, or improvement of an Elderly Citizen
Activities Center;

2.  The value of real property and improvements
made available by the local government, or the value of the
Center, equals or exceeds the amount of the State grant;

3.  No State funds have been used for the
acquisition, construction, or maintenance of the building to be
converted, rehabilitated, renovated, or improved; and

4.  The State is not responsible for any bonded
indebtedness in connection with that building.

(7)  The Board of Public Works shall make allocations from
funds available under this Act in accordance with this Act. The
Board shall certify the allocations to the proper State officers,
and the Treasurer shall make payments to the appropriate local
government agency, when needed, for eligible work.

(8)  (i) If, within 15 years after completion of a project,
property with respect to which funds have been paid under this
Act is sold or transferred for use other than as an Elderly
Citizen Activities Center or to any person, agency, or
organization that is not approved as a transferee by the Board of
Public Works, or if, within the same period, such property ceases
to be operated as a public facility, then the State may recover
from either the transferor or transferee or, in the case of
property that ceases to be operated as a public facility, from
the owner, an amount bearing the same ratio to the then-current
value of so much of the property as constituted an approved
project as the amount of the State participation bore to the
total eligible cost of the approved project, together with all
