CHAPTER 502

(Senate Bill 33)

AN ACT concerning

Pawnbrokers Dealers - Release of Certain Items

FOR the purpose of requiring secondhand precious metals dealers
and pawnbrokers to release certain stolen items, upon
demand, to the appropriate law enforcement agencies agency
agencies in a certain county under specific circumstances;
requiring law enforcement agencies to release stolen items
to the actual owners when there is no longer any evidentiary
need for the items; providing that secondhand precious
metals dealers and pawnbrokers releasing items under this

Act may not are not entitled to receive certain

reimbursement; providing that secondhand precious metal
dealers and pawnbrokers and law enforcement agencies acting
in good faith under this Act are immune from civil action;
and providing for the applicability of this Act.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 56 - Licenses

424A.

(A) A PAWNBROKER DEALER SHALL RELEASE TO THE APPROPRIATE
LAW ENFORCEMENT AGENCY IN THE COUNTY IN WHICH THE ESTABLISHMENT
OF THE DEALER DEALER'S PLACE OF BUSINESS IS LOCATED ANY ITEM OF
PERSONAL PROPERTY OR OTHER VALUABLE THING LOCATED IN THE PAWNSHOP
ESTABLISHMENT OF THE DEALER DEALER'S PLACE OF BUSINESS, OTHER
THAN SECURITIES OR PRINTED EVIDENCES OF INDEBTEDNESS, IF THE ITEM
HAS BEEN:

(1) ESTABLISHED TO HAVE BEEN STOLEN WITHIN THE

BOUNDARIES OF THIS STATE; AND
