(c) The prohibitions in this section do not apply to
special 1-day licenses or to Class B beer, wine and liquor
restaurant licenses to bona fide restaurants having:

(1)  A minimum capital investment of $150,000 for
restaurant facilities, not including the cost of land and
building; and

(2)  A minimum seating capacity of 75 persons.

SECTION 2. AND BE IT FURTHER ENACTED, That after July 1,
1985, at any hearing on an application for a transfer of the
location of an existing alcoholic beverages license within the
4th Legislative District of Baltimore City areas specified in
this Act, the Baltimore City board of license commissioners in
addition to any procedure currently used to arrive at their
decision shall:

(1)  Require that the person to whom the license is to
be transferred establish an existing need for that license in the
community that immediately surrounds the proposed new location;
and

(2)  Allow residents of the community that immediately
surrounds the proposed new location to voice their position on
the transfer; and

(3)  Consider both the existing need and the
community's position and shall reflect these in their decision.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1985.

(House Bill 1431)

AN ACT concerning

Creation of a State Debt - Baltimore Convention Center

FOR the purpose of authorizing the creation of a State Debt in
the amount of $5,000,000, the proceeds to be used as a grant
to the Mayor and City Council of Baltimore for the purpose
of altering, renovating, expanding and enlarging the
Baltimore Convention Center at One West Pratt Street in
Baltimore City, subject to the condition that the Mayor and
