CHAPTER 391

(House Bill 1002)

AN ACT concerning

Crimes and Punishments - Inmate Assault

FOR the purpose of providing for a consecutive sentence for an
inmate of the Division of Correction or of other certain
detention centers and jails who is convicted of assaulting
another inmate; providing that the sentence may not be
suspended; and generally relating to penalties for inmate
assault upon other inmates.

BY repealing and reenacting, with amendments,

Article 27 - Crimes and Punishments

Section 11E

Annotated Code of Maryland

(1982 Replacement Volume and 1984 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 27 - Crimes and Punishments

HE.

(a)  Every inmate convicted of assault on ANOTHER INMATE OR
ON an employee of the Division of Correction, the Patuxent
Institution, the Baltimore City Jail, or any county jail or
detention center, regardless of employment capacity, shall be
sentenced for the crime of assault under this section.

(b)  A sentence imposed under this section shall run
consecutively to any sentence that was being served at the time
of the assault, or that had been imposed but was not yet being
served at the time of sentencing.

(c)  A sentence imposed under this section may not be
suspended.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1985.
