AN ACT concerning

Montgomery County Housing - Public Hearings
MC 537-85

FOR the purpose of providing that certain provisions of law that
relate to public hearing requirements for the location by
the Housing Opportunities Commission of assisted family
housing in Montgomery County do not apply under certain
circumstances.

BY repealing and reenacting, with amendments,

Preamble

WHEREAS, Montgomery County Public Local Law Section 25B-6
requires that the Housing Opportunities Commission conduct a
public hearing prior to locating "assisted family housing" in the
County, but exempts moderately priced dwelling units and
scattered site units from the requirement; and

WHEREAS, Statewide law does not exempt moderately priced
dwelling units and scattered site units from the requirement of a
public hearing prior to location of "assisted family housing" in
a community; and

WHEREAS, The inconsistency between statewide and public
local law in Montgomery County over public hearings by the
Housing Opportunities Commission creates confusion over the
necessity for a public hearing; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
