INSTRUCTOR MAY NOT SURRENDER THE LICENSE NOR MAY THE LICENSE
LAPSE BY OPERATION OF LAW WHILE THE LICENSEE IS UNDER
INVESTIGATION OR WHILE CHARGES ARE PENDING AGAINST THE LICENSEE.

(B) THE BOARD MAY SET CONDITIONS ON ITS AGREEMENT WITH THE
LICENSED ELECTROLOGIST OR LICENSED ELECTROLOGY INSTRUCTOR UNDER
INVESTIGATION OR AGAINST WHOM CHARGES ARE PENDING TO ACCEPT
SURRENDER OF THE LICENSE.

5-311.

(a) Subject to the hearing provisions of § 5-312 of this
subtitle, the Board may deny a license to any applicant,
reprimand any licensee, place any licensee on probation, or
suspend or revoke a license if the applicant or licensee:

(20)  Promotes the sale of devices, appliances, or
goods to a patient so as to exploit the patient for financial
gain; [or]

(21)  Behaves immorally in the practice of
electrology[.]; OR

(22)  COMMITS AN ACT OF UNPROFESSIONAL CONDUCT IN THE
PRACTICE OF ELECTROLOGY.

5-313.

(C) THE BOARD MAY APPEAL FROM ANY DECISION THAT REVERSES OR
MODIFIES ITS ORDER.

6-314.

(A)  The Board shall reinstate the license of an individual
who has failed to renew a mortician license for any reason if the
individual:

(1)  Requests that the Board reinstate the license;

(2)  Meets the appropriate renewal requirements of
this subtitle;

(3)  Pays to the Board a reinstatement fee set by the
Board; [and]

(4)  Submits to the Board an affidavit stating that
the individual did not practice mortuary science in this State
while the license was expired[.]; AND

(5)  APPLIES TO THE BOARD FOR REINSTATEMENT OF THE
LICENSE WITHIN 5 YEARS AFTER THE LICENSE EXPIRES.

(B)  THE BOARD MAY NOT REINSTATE THE LICENSE OF A MORTICIAN
WHO FAILS TO APPLY FOR REINSTATEMENT OF THE LICENSE WITHIN 5
YEARS AFTER THE LICENSE EXPIRES. HOWEVER, THE MORTICIAN MAY
