Registration

5.5-201.

There is a State Board of Environmental Sanitarian
Registration in the Department.

5.5-202.

(a)  (1) The Board consists of [8] 9 members appointed by
the Governor with the advice of the Secretary, and with the
advice and consent of the Senate.

(2)  Of the [8] 9 Board members:

(i) [7, at least 1 of whom is not an employee
of the State, the United States, or a local government] 7 shall
be registered environmental sanitarians[. Of the remaining
members] APPOINTED AS FOLLOWS:

.1. 1 SHALL BE EMPLOYED BY PRIVATE
INDUSTRY;

[1.] 2. 2 shall [represent] BE EMPLOYED
BY the [Department of Health and Mental Hygiene] OFFICE OF
ENVIRONMENTAL PROGRAMS;

[2.] 3. 1 shall [represent] BE EMPLOYED
BY A local health [services] DEPARTMENT and be employed under the
State Personnel System;

[3.] 4. 1 shall [represent] BE EMPLOYED
BY a local health department in Baltimore City, Baltimore County,
or Montgomery County OR BY THE MONTGOMERY COUNTY DEPARTMENT OF
ENVIRONMENTAL PROTECTION; and

[4.] 5. 2 shall be appointed at large.
Their selection shall balancthe BALANCE THE Board as to
geographical distribution throughout the State and may not
include a second selection from any jurisdiction already
represented; and

(ii) [1] 2 shall be [a] consumer [member]

MEMBERS.

(3)  All Board members shall be residents of the
State.

(b)  The consumer [member] MEMBERS of the Board:

(1)  Shall be [a member] MEMBERS of the general
public;

(2)  May not be [a] registered environmental
[sanitarian] SANITARIANS;
