SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 56 - Licenses
252.
(a) The Secretary of Licensing and Regulation, shall
appoint an executive director who shall be a full-time employee
of the State[. He may be removed by the Secretary for
incompetence or neglect of duty; but before the executive
director may be removed from office he shall be given a copy of
the charges against him and an opportunity of being publicly
heard in person or by counsel in his own defense upon not less
than ten days' notice.] AND SHALL SERVE AT THE PLEASURE OF THE
SECRETARY.
The executive director shall:
(1) Take charge of the office of the Commission and
is in complete charge of the day to day operation of such office
and shall be responsible to the Secretary of Licensing and
Regulation;
(2) Have custody of the official records and the
seal; and
(3) Collect, account for, and pay over all fees
required by this subtitle in such manner as may be determined by
rule or regulation of the Comptroller of the State of Maryland.
The executive director shall, upon entering the performance of
his duties, be covered by a surety bond in accordance with the
provisions of §§ 46 through 50 of Article 78A of the Annotated
Code of Maryland.
SECTION 2. AND BE IT FURTHER ENACTED, That any executive
director of the Home Improvement Commission appointed prior to
the effective date of this Act may be removed only in accordance
with the provisions of Article 56 § 252(a) in effect prior to the
effective date of this Act.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1985.
