(F)  FEDERAL AGENCY.
"FEDERAL AGENCY" MEANS:

(1)  THE UNITED STATES GOVERNMENT; OR

(2)  ANY AGENCY OF THE UNITED STATES GOVERNMENT.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former HE § 9-901(f).

In this subsection, the references to "United States
Government" are substituted for the former references
to "United States of America" and "United States", for
clarity.

In item (2) of this subsection, the former references
to "department", "bureau", and "instrumentality" are
deleted as unnecessary in light of the use of the
broad, general word "agency".

(G)  GOVERNING BODY.

"GOVERNING BODY" MEANS THE UNIT OF A POLITICAL SUBDIVISION
THAT IS AUTHORIZED BY LAW TO ENACT LAWS FOR THE POLITICAL
SUBDIVISION.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former HE § 9-901(g).

The term "unit" is substituted for the former
reference "body or board", for clarity.

(H) IMPROVEMENT.

"IMPROVEMENT" MEANS THE CONSTRUCTION, REPAIR, REPLACEMENT,
OR BETTERMENT OF, OR ADDITIONS TO, A PROJECT:

(1)  TO PLACE OR MAINTAIN THE PROJECT IN PROPER
CONDITION FOR SAFE, EFFICIENT, AND ECONOMIC OPERATION; OR

(2)  TO MEET REQUIREMENTS FOR SERVICE IN AREAS THAT:

(I)  MAY BE SERVED BY THE AUTHORITY; AND

(II)  ARE NOT CURRENTLY BEING SERVED.

REVISOR'S NOTE: This subsection formerly appeared as HE §
9-901(h).

Throughout this subsection, "project" is substituted
for the former references to "water system", "sewerage
system", and "the system" in light of the definition
of "project" in this section.
