SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1985.

(Senate Bill 191)

AN ACT concerning

State Lottery - Obligations

FOR the purpose of prohibiting the State and certain units of
State government from raising the defense of sovereign

immunity in the courts of this State in an action in

contract that is based on the liability of the State to  pay

the annuitant of a certain ticket the prize that the

annuitant is entitled to receive in accordance with the
Maryland State Lottery Law and certain regulations.

Annotated Code of Maryland
(1984 Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - State Government

9-122.

(F) UNLESS OTHERWISE SPECIFICALLY PROVIDED BY THE LAWS OF
THE STATE, THE STATE AND EVERY OFFICER, DEPARTMENT, AGENCY,
BOARD, COMMISSION, OR OTHER UNIT OF STATE GOVERNMENT MAY NOT
RAISE THE DEFENSE OF SOVEREIGN IMMUNITY IN THE COURTS OF THE
STATE IN AN ACTION IN CONTRACT BROUGHT BY AN ANNUITANT THAT IS
BASED ON THE LIABILITY OF THE STATE TO PAY AN ANNUITANT THE PRIZE
THAT THE ANNUITANT IS ENTITLED TO RECEIVE IN ACCORDANCE WITH THIS
SUBTITLE AND ANY REGULATIONS ADOPTED UNDER THIS SUBTITLE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1985.
