HARRY HUGHES, Governor

173

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 81, § 9(a)
and (g)(1), as they related to the exemption for a
disabled veteran, or the surviving spouse of a
disabled veteran, and (3) through (5).

In this section, the scope of the term "veteran" is
determined by the criteria applied to the term by the
United States Veterans' Administration.

Subsection (a)(2) of this section is revised as a
definition of "disabled veteran", for brevity and
clarity.

Also in subsection (a)(2) of this section, the defined
term "disabled veteran" is substituted for the former
phrase "citizen and resident of the State", in light
of the residency requirements of this section.

In subsection (a)(2)(i) of this section, the scope of
the term "active service" is determined by the
criteria applied by the United States Veterans'
Administration.

In subsection (a)(2)(ii)l. of this section, the former
reference to the continuing nature of the disability
being "affirmatively shown" is deleted as superfluous.

In subsection (a)(3) of this section, the defined term
is changed from the former word "property" to
"dwelling house" to avoid confusion with the
definition of "property" in § 1-101 of this article
and to clarify that the exemption is for the "dwelling
house".

In subsection (a)(3)(i) and (ii) of this section, the
defined term "real property" is substituted for the
former term "dwelling", for clarity.

In subsection (a)(3)(i) of this section, the former
reference to "located in this State" is deleted as
superfluous.

In subsection (a)(3)(i)l. and (f) of this section, the
defined terms "disabled veteran" and "surviving
spouse" are substituted for the former references to
"the person entitled to an exemption hereunder", which
may mean either a "disabled veteran" or a "surviving
spouse".

Subsection (a)(4) of this section is restated as a
definition of "surviving spouse" for brevity and to
avoid repetition of former references such as the
"surviving spouse of a qualified disabled veteran" who
"has remained unmarried" or "until remarriage".
