(B) "AFFECTED EMPLOYEE" MEANS AN EMPLOYEE WHO WORKED FOR AT
LEAST 13 WEEKS DURING THE PRECEDING 52 WEEKS AT A WORKPLACE AND
WHOSE EMPLOYMENT IS TERMINATED BY A REDUCTION IN OPERATIONS AT
THAT WORKPLACE.

(C) "BUREAU" MEANS THE BUREAU OF EMPLOYMENT STABILIZATION.

(D) "COMMUNITY" MEANS THE CITY OR COUNTY IN WHICH THE
BUSINESS OPERATION IS LOCATED.

(E) "COMMUNITY OWNED BUSINESS" MEANS A BUSINESS THAT IS:

(1) AT LEAST 51 PERCENT OWNED BY A NONPROFIT

CORPORATION ESTABLISHED PRIMARILY FOR THE PURPOSE OF ADVANCING
THE ECONOMIC DEVELOPMENT OF THE COMMUNITY IF THE MAJORITY OF THE
MEMBERS OF THE CONTROLLING BOARD OF DIRECTORS OF THE NONPROFIT
CORPORATION IS COMPRISED OF ELECTED REPRESENTATIVES OF THE
COMMUNITY; OR

(2) AT LEAST 51 PERCENT OWNED BY THE CITY OR COUNTY
IN WHICH THE WORKPLACE OF THE BUSINESS OPERATION IS LOCATED AND
WHICH IS CONTROLLED BY THE ELECTORATE OF THE CITY OR COUNTY
THROUGH ELECTED OFFICIALS OR AN ELECTED OR APPOINTED BOARD OF
DIRECTORS.

(F) "DIRECTOR" MEANS THE DIRECTOR OF THE BUREAU OF

EMPLOYMENT STABILIZATION.

(C) "EMPLOYEE OWNED BUSINESS" MEANS A BUSINESS OPERATION
OWNED ENTIRELY BY ITS EMPLOYEES AND CONTROLLED BY THE EMPLOYEES
OR BY A BOARD OF DIRECTORS SELECTED BY THE EMPLOYEES.

(H) (B) (1) "EMPLOYER" MEANS ANY PERSON, CORPORATION, OR
OTHER ENTITY THAT EMPLOYS AT LEAST 300 50 INDIVIDUALS AND
OPERATES AN INDUSTRIAL, COMMERCIAL, OR BUSINESS ENTERPRISE IN THE
STATE.

(2) "EMPLOYER" DOES NOT INCLUDE THE STATE OR ITS
POLITICAL SUBDIVISIONS OR ANY EMPLOYER WHO HAS BEEN DOING
BUSINESS IN THE STATE LESS THAN 1 YEAR.

(I) "JOINTLY OWNED BUSINESS" MEANS A BUSINESS OPERATION
OWNED JOINTLY BY A CITY OR COUNTY AND THE EMPLOYEES OF THE
BUSINESS OPERATION AND CONTROLLED BY A BOARD OF DIRECTORS
SELECTED BY THE CITY, COUNTY, OR EMPLOYEES.

(J) (C) "REDUCTION IN OPERATIONS" INCLUDES:

(1)  THE RELOCATION OF A PART OF AN EMPLOYER'S
OPERATION FROM 1 WORKPLACE TO ANOTHER EXISTING OR PROPOSED SITE
EITHER WITHIN OR OUTSIDE THE STATE; OR

(2)  THE SHUTTING DOWN WITHIN THE STATE OF A WORKPLACE
OR A PORTION OF THE OPERATIONS OF A WORKPLACE THAT REDUCES THE
NUMBER OF EMPLOYEES BY AT LEAST 25 PERCENT OR 15 EMPLOYEES,
WHICHEVER IS GREATER, OVER ANY 3-MONTH PERIOD.
