written to buyers or prospective buyers that the vehicles
have been damaged or repaired; and generally relating to a
prohibition of an offer for sale or sale of certain vehicles
that have been damaged or repaired without a certain written
disclosure allowing the Motor Vehicle Administration to
refuse to grant, or to suspend, revoke, or refuse to renew,
a manufacturer's, distributor's, or factory branch's license
if it finds that the manufacturer, distributor, or factory
branch made any material misrepresentation in transferring a
vehicle to a dealer.

BY adding to BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Transportation

15-210.1.

A MANUFACTURER, DISTRIBUTOR, OR FACTORY BRANCH, WHETHER
DIRECTLY OR THROUGH AN AGENT, EMPLOYEE, OR REPRESENTATIVE, MAY
NOT CONCEAL INFORMATION CONCERNING DAMAGE OR REPAIR TO A VEHICLE
THAT OCCURRED PRIOR TO THE DELIVERY OF THE VEHICLE TO A DEALER.

15-311.

(D) UNLESS A DEALER DISCLOSES IN WRITING TO A BUYER OR
PROSPECTIVE BUYER THAT A NEW VEHICLE OR A VEHICLE USED BY THE
DEALER HAS BEEN DAMAGED OR REPAIRED, A DEALER, WHETHER DIRECTLY
OR THROUGH AN AGENT, EMPLOYEE, OR REPRESENTATIVE, MAY NOT OFFER
FOR SALE OR SELL A NEW VEHICLE OR A VEHICLE USED BY THE DEALER
THAT HAS BEEN DAMAGED OR REPAIRED.

15-212.

(a) In addition to the other grounds specified in Subtitle
1 of this title for refusal, suspension, or revocation of a
license, the Administration may refuse to grant a license under
this subtitle to any person and may suspend, revoke, or refuse to
renew the license of any person if it finds that the person has:

(1) MADE ANY MATERIAL MISREPRESENTATION IN
TRANSFERRING A VEHICLE TO A DEALER;

[(1)] (2) Failed to comply with any written warranty
agreement; or

[(2)] (3) Failed to reasonably compensate any
franchised dealer who does work under:
