County; repealing a provision relating to the minimum annual
salary for the county jailer; and providing for a delayed
effective date for this Act.

Section 2-309(u)

SECTION 1. BE IX ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Courts and Judicial Proceedings

2-309.

(u) (1) (I) The Sheriff of Somerset County shall receive a
salary of not less than $16,000 and no expense allowance. He
shall appoint a chief deputy who shall receive a salary of not
less than $7,500. Subject to the approval of the County
Commissioners, the Sheriff may appoint additional deputies at the
compensation set by the County Commissioners prior to any
appointment. [The Sheriff or one of his deputies shall act as
county jailer and shall receive annual total compensation of not
less than $6,000.]

(II) THE COUNTY COMMISSIONERS SHALL APPOINT A
JAIL WARDEN AS THE COUNTY JAILER. PRIOR TO THE APPOINTMENT OF
ANY INDIVIDUAL, THE COUNTY COMMISSIONERS SHALL ESTABLISH AN
ANNUAL RATE OF COMPENSATION FOR THE COUNTY JAILER.

(2)  The Sheriff and his deputies may wear uniforms
when performing their official duties, and the automobiles used
by the Sheriff's office shall be equipped with a two-way radio.

(3)  The County Commissioners may pay for the
uniforms, radios, automobiles, and" operating expenses of the
automobiles of the Sheriff's office.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect December 1, 1986.
