AN ACT concerning

Election Code - Candidate Vacancy

FOR the purpose of clarifying the process for selection of
candidates for certain vacant offices.

BY repealing and reenacting, with amendments,

Article 33 - Election Code

Section 4A-4(a)

Annotated Code of Maryland

(1983 Replacement Volume and 1984 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 33 - Election Code

4A-4.

(a) In case of any vacancy which may exist in respect to a
candidate for any [officer] OFFICE elected by the voters of more
than one county [or Baltimore City] except State Senator or
member of the House of Delegates, by reason of there being no
candidate of a political party to file for the same in any such
primary election, such vacancy shall be filled by the State
central committee, or governing body, of the political party of
the State.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1985.
