Former subsection (b) of this section defined
"[a]nnual consultation tour" for purposes of this
article. However, the defined term appeared only
once, in former § 2-103(e-l) of this article. Also,
former subsection (b) of this section contained
substantive provisions. Therefore, former subsection
(b) of this section and § 2-103(e-l) of this article
are revised together, in § 2-103.1(e) of this article.
Similarly, subsections (d), (h), and (n) of this
section, which formerly defined, respectively,
"Consolidated Transportation Program", "Maryland
Transportation Plan", and "State Report on
Transportation", by reference to documents "described
in § 2-103", contained substantive requirements.
However, additional substantive requirements also
appeared in former § 2-103.1 of this article and in
former Art. 15A, § 9A(c).
Chapter ____, Acts of 1985, revised all of the
substantive provisions as to the State Report on
Transportation and its components in § 2-103.1 of this
article. Therefore, in subsections (d), (h), and (n)
of this section, the cross-reference to "§ 2-103.1" is
substituted for the former cross-reference to "§
2-103", and the substantive requirements are deleted.
In subsections (d) and (h) of this section, the former
references to preparation of the Program and Plan "by
the Department" are deleted as inconsistent with the
substantive provision of § 2-103(e)(2) that imposes
this duty on the Secretary.
2-103.
(a) (1) The Secretary is responsible for the budget of
[his] THE office OF THE SECRETARY and for the budget of each unit
in the Department.
(2) THE BUDGET REQUEST THAT THE SECRETARY SUBMITS FOR
THE DEPARTMENT SHALL CONTAIN, FOR EACH MODAL ADMINISTRATION,
SEPARATE ITEMS FOR:
(I) CAPITAL EXPENDITURES; AND
(II) OPERATING EXPENDITURES.
(3) WHENEVER THE PROPOSED BUDGET OF THE GOVERNOR
INCLUDES FOR THE DEPARTMENT TOTAL CAPITAL AND OPERATING
EXPENDITURES THAT EXCEED THE EXPENDITURES PROPOSED IN THE
CONSOLIDATED TRANSPORTATION PROGRAM, THE DEPARTMENT SHALL SUBMIT
TO THE GENERAL ASSEMBLY, SUBJECT TO § 2-1312 OF THE STATE
GOVERNMENT ARTICLE, A RECONCILIATION REPORT THAT SPECIFICALLY
SETS FORTH THE PROPOSED PROJECTS FOR WHICH THE ADDITIONAL
EXPENDITURES ARE REQUESTED.
