(C) OTHER AID.
(1) THIS SUBSECTION DOES NOT APPLY TO AN
INSTRUCTIONAL CONTRACT, INSTRUCTIONAL GRANT, RESEARCH CONTRACT,
OR RESEARCH GRANT.
(2) WITHIN 30 DAYS AFTER A LOCAL GOVERNMENT RECEIVES
AN AWARD OF FEDERAL AID, THE LOCAL GOVERNMENT SHALL SUBMIT TO THE
DEPARTMENT OF STATE PLANNING A SUMMARY NOTICE THAT STATES:
(i) THE AMOUNT OF THE AWARD; AND
(ii) IF THE AWARD IS CONDITIONED ON MATCHING
FUNDS:
1. THE AMOUNT OF THOSE FUNDS;
2. THE SOURCE OF THOSE FUNDS; AND
3. THE PERIOD FOR WHICH THOSE FUNDS ARE
REQUIRED.
REVISOR'S NOTE: Chapter ____, Acts of 1985, which enacted
the ' State Finance and Procurement Article, also
enacted this section, which is new language derived
without substantive change from former Art. 88C, §
13(b) and (c), as those subsections related to local
governments.
In subsection (a) of this section, the word
"consultation" is substituted for the former word
"coordination", to avoid the suggestion that
promulgation of the regulations is a joint
responsibility.
Also in subsection (a) of this section, the reference
to adoption by the "Secretary of State Planning" is
substituted for the former reference to the
"Department", to conform to SF § 5-204(b), which
requires the Secretary to adopt departmental
regulations.
Subsection (b) of this section is revised to require a
local government to submit a notice only if the
government has received the award within the reporting
period. Former Art. 88C, § 13(c) -- from which
subsection (b) of this section is derived -- did not
indicate to whom the filing requirement applied. This
revision is based on the regulations. Those
regulations require submission of these notices on or
before January 30 and on or before July 30. See COMAR
16.02.01.05D.
