REVISOR'S NOTE: This section is new language that repeats
the provisions of present Art. 31, § 9(b)(1), (2), and
(4), § 11, and the second clause of § 12(e) and the
fourth sentence of (i).

In subsection (a)(l)(i) and (iv)2. of this section,
the present references to "notes or other securities"
and "notes" are omitted as unnecessary in light of the
definition of the word "bond".

In subsection (b)(1) of this section, the present
phrase "pursuant to any such general or special
authority heretofore or hereafter granted" is omitted
as unnecessary in light of the definition of the word
"bond".

The Commission to Revise the Annotated Code notes, for
the consideration of the General Assembly, that it may
wish to consider whether this revised section is
obsolete, since, as revised, it applies only to State
units and enabling acts generally expressly exempt
State units from the requirements of this section.

8-209. REFUNDING BONDS.

(A) AUTHORIZED.

SUBJECT TO THE LIMITATIONS IN THIS SECTION, WITH THE
APPROVAL OF THE BOARD OF PUBLIC WORKS, A STATE UNIT AUTHORIZED TO
ISSUE BONDS MAY ISSUE NEW BONDS TO REFUND ITS OUTSTANDING BONDS.
