expressly provided for an enabling act to govern the
use of the proceeds and the source of money for
redemption of the State bonds. The additions in
subsection (c) of this section reflect that,
notwithstanding the broad language of former § 2B(h),
that former subsection was limited by § 2B(a), (g),
and (i). In light of these additions, former § 2B(h)
is deleted.

The second sentence of former Art. 31, § 2B(d), which
required the State bonds to be signed and
countersigned as provided in Md. Constitution, Art.
VI, § 3, is deleted as unnecessary and misleading,
since the former sentence stated a requirement only
for State bonds of a consolidated issue, while the
referenced constitutional provision applies to all
State bonds.

Former Art. 31, § 2B(e), which required that, "[i]n
the adoption of the resolution" for a consolidated
issue, the Board determine "the matters provided for
in § 21", is deleted as inaccurate. Under §§ 8-120
and 8-121 of this subtitle, the determination of those
matters is discretionary. Ch. 719, Acts of 1982,
substituted the former cross-reference for a list of
specific matters to be determined in connection with
consolidated issues, in part, to "confor[m] the
different provisions that relate to issuance and sale
of State ... bonds on a consolidated basis".
Therefore, the former cross-reference did not seem to
be intended to state a duty.

The first sentence of former Art. 31, § 2B(f), which
provided that former § 2B is "permissive only" and
that consolidation is within the "discretion of the
Board", is deleted as unnecessary in light of the use
of the word "may" in subsection (a) of this section.

The second sentence of former Art. 31, § 2B(f), which
required the decision to be made "by a majority", is
deleted as unnecessary. See revisor's note to § 8-119
of this subtitle.

The provisions of former Art. 31, § 2B(a) that
referred to the date of enactment of the enabling act

now appear in the Session Laws. See Section ___ of

Ch. ___, Acts of 1985.
