[(11)] (K) The Secretary shall submit a budget to the
General Assembly for approval. The budget may not exceed the
amount available in the maintenance fund.

[(12)] (L) The funds contributed to the Department from the
Pennsylvania Electric Company for capital improvements shall be
deposited in the fund and spent in accordance with the approved
development plan.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1984.

AN ACT concerning

Frederick County - Zoning and Planning Commission

FOR the purpose of providing that in Frederick County the Board
of County Commissioners by a certain vote may overrule a
recommendation of the Frederick County Planning Commission.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 66B - Zoning and Planning

3.08.1.

NOTWITHSTANDING ANY OTHER PROVISION IN THIS ARTICLE, IN
FREDERICK COUNTY, THE BOARD OF COUNTY COMMISSIONERS MAY OVERRULE
THE ACTION OF THE FREDERICK COUNTY PLANNING COMMISSION BY A
MAJORITY VOTE OF THE MEMBERSHIP OF THE BOARD OF COUNTY
COMMISSIONERS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1984.
