be construed or interpreted to grant planning and zoning
authority or subdivision control to a municipality not authorized
to exercise that authority at the time of such annexation; and
further provided, that no municipality annexing land may for a
period of five years following annexation, place that land in a
zoning classification which permits a land use substantially
different from the use for the land specified in the current and
duly adopted master plan or plans or if there is no adopted or
approved master plan, the adopted or approved general plan or
plans of the county or agency having planning and zoning
jurisdiction over the land prior to its annexation without the
express approval of the board of county commissioners or county
council of the county in which the municipality is located.

(mm) (1) To enact laws or regulations designed to prevent
conflicts between the private interests and public duties of any
county officers or employees, including the county commissioners,
and to govern the conduct and actions of all such county officers
and employees in the performance of their public duties, and to
provide for penalties, including fines, forfeitures,
imprisonment, and removal from office for violation of any such
laws or regulations.

(2) This [section] SUBSECTION applies to the county
commissioners of each county, including those otherwise exempted
by subsection (a)(2) of this section.

87.

(a)  All drainage improvements constructed under §§ 52
through 95 of this article shall be under the control and
supervision of the county board of managers. It shall be the
duty of the board to keep the drainage improvements in good
repair.

(b)  Also for this purpose, the county board of managers may
at any time levy a tax for drainage improvements maintenance on
the lands benefited. Taxes for maintenance purposes shall be
levied, collected and disbursed in the same manner as were the
original taxes for drainage improvements.

(c)   If the [Caroline County] board of managers requests,
the [Caroline County Commissioners] COUNTY COMMISSIONERS may
appoint a board of drainage viewers to evaluate changes in land
use made after the original assessment for drainage improvement.
The county board of managers may use the evaluation report as a
basis for the levy of a tax for drainage improvements
maintenance.
