SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health - Environmental

[Subtitle 1. Controlled Poisons]

[5-101.

(a)  In this subtitle the following words have the meanings
indicated.

(b)  "Authorized prescriber" means any individual authorized
by law to prescribe drugs or medicines.

(c)  "Board" means the State Board of Pharmacy.

(d)  "Controlled poison" means any poison that is listed in
the Schedule of Controlled Poisons.

(e)  "Licensed pharmacist" means a pharmacist who is
licensed by the Board to practice pharmacy.]

[5-102.

Except for the labeling requirements of § 5-114 of this
subtitle, this subtitle does not apply to the sale of any
controlled poison:

(1)  To a person who the seller knows to be engaged in
the arts, agriculture, or industry if the seller believes that
the controlled poison is intended for lawful use in the arts,
agriculture, or industry;

(2)  To a manufacturer or wholesale dealer if the sale
is made by a licensed pharmacist, a manufacturer, or a wholesale
dealer;

(3)  To an authorized prescriber;

(4)  To a licensed pharmacist;

(5)  To a manufacturer of a proprietary medicine;

(6)  To a hospital or scientific institution;

(7)  To a school or public institution; or

(8)  To a holder of a poison permit issued under §
5-112 of this subtitle, if:
