Physicians Physicians - Medical Consent - Licensing Exemption for
Olympic Team Physicians Physicians
FOR the purpose of permitting certain physicians to practice
medicine without a license while providing certain care and
treatment to certain individuals during the qualifying games
for the XXIII Olympiad; and providing certain substitute
consent for hospital, medical, and surgical care of a team
member who is a minor.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That:
(1) Subject to the rules, regulations, and orders of the
State Board of Medical Examiners and the Commission on Medical
Discipline of Maryland, a physician may practice medicine without
a license while the physician:
(I) Currently is authorized to practice medicine in
another state or country;
(II) Is serving as a physician for a team that:
1. Is participating in the qualifying games
held in this State for the XXIII Olympiad;
2. Is from the state or country of the
physician; and
3. On or before the date of the arrival of the
team, has submitted the name of the physician to the Board; and
(III) Is providing care and treatment that is limited
exclusively to a member of the Olympic team from the state or
country of the physician.
(2) If any member of an Olympic team requires any type of
care or treatment in an acute care hospital, the physician shall
refer the member to a physician licensed by this State.
(3) (I) Notwithstanding any other provision of the law, the
official team manager who is responsible for any team member
participating in the games of the XXIII Olympiad in Maryland may
give consent to the furnishing of hospital, medical, and surgical
care to a minor who is a team member, and that consent shall not
be subject to disaffirmance because of the minority of that team
member.
(II) The consent of the parent, guardian, or
custodian of that minor shall not be necessary in order to
authorize hospital, medical, and surgical care.
