Ch. 168

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Agriculture

2-311.

(e) The licensee may appeal to the circuit court of the
county where [he] THE LICENSEE has an office. The court shall
hear and determine [de novo] all matters connected with the
action of the Board from which appeal is taken IN ACCORDANCE WITH
THE ADMINISTRATIVE PROCEDURE ACT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1984.

(House Bill 221)

AN ACT concerning

Agriculture - Tobacco Sales

FOR the purpose of requiring that sellers of tobacco post a bond
with the Secretary of the Department of Agriculture.

BY repealing and reenacting, with amendments,

Article - Agriculture

Section 7-401

Annotated Code of Maryland

(1974 Volume and 1983 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Agriculture

7-401.

Any person who sells hogsheads, baskets, or other containers
of leaf tobacco directly for the grower, shall first give a bond
for the penalty in the amount of $10,000. The bond shall be
deposited with the [State Comptroller] SECRETARY OF THE
DEPARTMENT OF AGRICULTURE, to protect the growers from any loss
sustained from any failure of the seller.
