CHAPTER 108

(Senate Bill 297)

AN ACT concerning

Maryland State Police - Deputy Superintendents

FOR the purpose of authorizing the Superintendent of the Maryland
State Police to appoint more than one two of the police
employees holding the highest commissioned rank to be deputy
superintendents, with the approval of the Secretary of
Public Safety and Correctional Services; providing that the
Superintendent may designate a deputy superintendent to act
in the superintendent's place under certain circumstances
and with certain responsibilities; providing certain legal
authority for a senior deputy superintendent when the
superintendent fails to designate a deputy superintendent to
act under certain circumstances; and making certain
stylistic changes.

BY repealing and reenacting, with amendments,

Article 88B - State Police

Section 16

Annotated Code of Maryland

(1979 Replacement Volume and 1983 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 88B - State Police

16.

The Superintendent [shall] MAY, with the approval of the
Secretary of Public Safety and Correctional Services, designate
without examination, to serve at the Superintendent's pleasure,
MORE THAN one TWO of the police employees holding the highest
commissioned rank to be deputy superintendent SUPERINTENDENTS.
The deputy [superintendent] SUPERINTENDENTS shall have such
authority, responsibility, and duties as may be assigned by the
Superintendent and, in case of the absence from the State or
incapacitating disability of the Superintendent, ONE OF THE
DEPUTY SUPERINTENDENTS SHALL BE DESIGNATED BY THE SUPERINTENDENT
AND shall have all of the powers and duties conferred by law upon
the Superintendent. IF THE SUPERINTENDENT IS UNABLE, DUE TO
ILLNESS, INJURY OR OTHER SUDDEN DISABILITY, TO DESIGNATE ONE OF
THE DEPUTY SUPERINTENDENTS TO ACT DURING THE PERIOD OF
INCAPACITATING DISABILITY, THE SENIOR DEPUTY SUPERINTENDENT SHALL
