SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 56 - Licenses
329.
(a) The Board, after compliance with the Administrative
Procedure Act, may suspend or revoke any license issued under
this subtitle if:
(1) The licensee, knowingly or without the exercise
of due care to prevent violation, has violated any provision of §
14-202 of the Commercial Law Article, or has failed to comply
with any demand, or requirement, lawfully made by the Board under
this subtitle; or
(2) Any material misrepresentation has been made in
the application for the license.
(B) IN DETERMINING WHETHER TO REVOKE OR SUSPEND A LICENSE
THE BOARD MAY:
(1) HOLD A HEARING AT A TIME AND PLACE IN THIS STATE
THAT IS REASONABLY CONVENIENT TO THE PARTIES INVOLVED;
(2) SUBPOENA WITNESSES FOR ATTENDANCE AND , TESTIMONY
ONLY, AND NOT FOR INVESTIGATIVE PURPOSES; AND
(3) ADMINISTER OATHS.
(C) (1) IF ANY PERSON FAILS TO COMPLY WITH AN ORDER OR
SUBPOENA OF THE BOARD UNDER THIS SUBTITLE OR TO APPEAR AS A
WITNESS AND TESTIFY CONCERNING ANY MATTER ABOUT WHICH THE PERSON
MAY BE INTERROGATED UNDER THIS SUBTITLE, THE BOARD MAY FILE A
PETITION FOR ENFORCEMENT WITH THE CIRCUIT COURT OF ANY COUNTY OR
BALTIMORE CITY.
[(b)] (D) If the Board finds that grounds for revocation or
suspension are of general application to more than one place of
business operated by the licensee, the Board may revoke or
suspend all of the licenses issued to the licensee, or only those
licenses to which the grounds for revocation or suspension apply.
Otherwise, the Board shall suspend or revoke only the particular
license with respect to which grounds for revocation or
suspension may occur or exist.
[(c)] (E) Any licensee may surrender any license by
delivering to the Board written notice that the license is
surrendered, but surrender of the license does not affect the
licensee's civil or criminal liability for acts committed prior
to the surrender of the license.
