VETOES

(A) IN ADDITION TO ITS AUTHORITY UNDER § 10-111(A) OF THIS
SUBTITLE TO REVIEW PROPOSED REGULATIONS AND CONDUCT APPROPRIATE
PROCEEDINGS, AND IN ADDITION TO ITS AUTHORITY UNDER § 10-111(B)
OF THIS SUBTITLE WITH REGARD TO THE EMERGENCY ADOPTION OF
REGULATIONS, THE COMMITTEE MAY, IN REVIEWING PROPOSED REGULATIONS
SUSPEND THE ADOPTION OF REGULATIONS UNDER THIS SECTION AFTER
REASONABLE NOTICE TO THE APPROPRIATE STANDING COMMITTEE, THE
PRESIDENT, THE SPEAKER AND THE UNIT.

(D) (B) (1) DURING THE REVIEW PERIOD UNDER § 10-111(A) AND
ANY EXTENSION THEREOF UNDER SUBSECTION (C) OF THIS SECTION, AND
SUBJECT TO THE OTHER PROVISIONS OF THIS SECTION, THE COMMITTEE
MAY ORDER THAT ADOPTION OF THE REGULATION OR ANY PORTION THEREOF
BE SUSPENDED AS PROVIDED IN PARAGRAPH (2) OF THIS SUBSECTION IF
THE COMMITTEE FINDS THE REGULATION OR THE SUSPENDED PORTION
THEREOF:

(I) IS UNCONSTITUTIONAL;

(II) EXCEEDS THE STATUTORY AUTHORITY OF THE
PROMULGATING UNIT;

(III) FAILS TO COMPLY WITH THE LEGISLATIVE
INTENT OF THE STATUTE AUTHORIZING IT; OR

(IV) IS UNREASONABLE OR UNNECESSARILY
BURDENSOME.

(2) THE SUSPENSION MAY BE FOR A PERIOD THAT EXPIRES
NOT LATER THAN THE FIRST DAY OF JUNE FOLLOWING THE REGULAR
SESSION OF THE GENERAL ASSEMBLY WHICH COMMENCES NEXT AFTER THE
DATE UPON WHICH THE REGULATIONS ARE INITIALLY PUBLISHED IN THE
REGISTER.

(E) PRIOR TO (C) AFTER ORDERING A SUSPENSION UNDER
SUBSECTION (D) (B) OF THIS SECTION, THE COMMITTEE SHALL:

(1) AFTER CONSULTATION WITH THE PRESIDING OFFICERS
OF THE HOUSE OF DELEGATES AND SENATE OF MARYLAND AS TO THE
APPROPRIATE STANDING COMMITTEES, ADVISE THOSE STANDING COMMITTEES
THAT THE REGULATION IS UNDER REVIEW AND MAY BE HAS BEEN
SUSPENDED; AND

(2) PROVIDE THOSE STANDING COMMITTEES 30 DAYS WITHIN
WHICH TO SUBMIT WRITTEN COMMENTS TO THE COMMITTEE REGARDING THE
PROPOSED SUSPENSION.

(F) (D) (1) A SUSPENSION UNDER SUBSECTION (D) (B) IS NOT
EFFECTIVE UNTIL THE COMMITTEE HAS PROVIDED THE PROMULGATING UNIT
AND THE DIVISION OF STATE DOCUMENTS WITH WRITTEN NOTICE OF THE
SUSPENSION AND THE TERMS THEREOF.

(2) THE NOTICE SHALL CONTAIN A BRIEF EXPLANATION OF
